1. Acceptance of Terms

By downloading, installing, or using the Ghost Run Club application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Ghost Run Club is a running and fitness application that allows you to track your runs, race against “ghost” versions of your past performances, and access various training features. The App is available for iOS devices and Apple Watch.

3. Ghost Run Pro Subscription

Ghost Run Club offers optional premium features through an auto-renewable subscription called “Ghost Run Pro.”

3.1 Subscription Options

* Prices may vary by region and are subject to change. Actual prices will be displayed in the App at the time of purchase.

3.2 Pro Features Include

• AI Coach & Personalized Insights
• Advanced Analytics (weekly trends, pace analysis, heart rate zones)
• AI-Generated Training Plans
• AI Workout Generator
• Custom Ghost Targets
• Data Export (GPX, CSV, JSON)

3.3 Billing and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your App Store account settings after purchase.

3.4 Free Trial

If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription. Free trial eligibility is determined by Apple and may not be available to all users.

3.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to Pro features until that time. No refunds will be provided for partial subscription periods.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality
• Share your account credentials with others
• Upload false, misleading, or inappropriate content

5. Health and Safety Disclaimer

Important: The App is intended for fitness tracking and motivation purposes only. It is not a medical device and should not be used for medical diagnosis or treatment.

• Consult a physician before beginning any exercise program
• Do not rely solely on heart rate data for medical decisions
• Be aware of your surroundings when running, especially when using audio feedback
• The App's pace suggestions and AI recommendations are for general fitness guidance only

6. Intellectual Property

The App, including all content, features, and functionality, is owned by Ghost Run Club and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Third-Party Services

The App may integrate with third-party services such as Apple Health, Strava, and cloud services. Your use of these integrations is subject to the respective third-party terms and privacy policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. GPS accuracy, heart rate readings, and other metrics may vary based on device capabilities and environmental conditions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOST RUN CLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ghost Run Club and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Apple-Specific Terms

If you are using the App on an Apple device, the following additional terms apply:

• These Terms are between you and Ghost Run Club only, not Apple.
• Apple has no obligation to furnish any maintenance and support services with respect to the App.
• Apple is not responsible for addressing any claims relating to the App.
• Apple is a third-party beneficiary of these Terms.
